
Conditions of sale
1) In these conditions of sale Mr Sticka are referred to as the company and the person or persons signing (purchasing) the contract are referred to as the customer.
2) Orders are accepted on the basis that these conditions of sale will apply to the exclusion of any conditions printed on the customers own stationery. Orders given verbally must be confirmed in writing; otherwise the company accepts no responsibility for errors in interpretation or delay in processing the order.
3) The placing of an order with the company will be deemed to bind the customer to the following terms and conditions and no oral representation shall bind the company. Any variation or alteration in the following terms and conditions shall only be binding upon the company if made in writing and signed by a director of the company.
4) Orders will be processed immediately on receipt of order. All specifications will be contained in this contract no other estimate quote etc will be regarded as any guide to the products to be supplied and it is therefore recommend that the customer thoroughly checks this contract to establish that this is exactly what they require.
5) The company reserve the right not to proceed with an order if it is not one that is: a) To be manufactured within their restrictions of production techniques and technical specification as outlined in the company technical manual b) Has not been ordered or priced correctly by the company or customer as per advertising literature
6) On acceptance of the order the company will advise the customer of the anticipated delivery period. If the work is not complete within the delivery or installation period advised and agreed. The customer may serve notice on the company in writing, requiring that the work is completed in such reasonable period as the customer may specify (in general the company would accept six weeks as being reasonable). If the work is not completed within such extended period, the customer may cancel the uncompleted work covered by the contract without penalty to himself by the service of a written notice to that effect on the company. Not withstanding the foregoing, the company shall not be liable for any delay in the completion of the work which arises from the causes beyond the control of the company and in the event that time has been made the essence of the contract, time shall not run during any period when delay on that account is operating whether written notice is being service to make time of the essence or cancellation is being effected after such notice. In the interests of certainty it is recommended that is sent by reordered delivery.
7) Demonstration of products are used to demonstrate the working of a typical product and its composition. The products detailed in the schedule will be manufactured by the company. Using such manner and materials considered suitable and pursuant to the company’s policy of continuous development and the standards of it’s products and manufacturing methods the company reserves the right to make any minor variations in the design and specifications of it’s products without notice it shall be under no obligation to supply goods exactly conforming in appearance to samples or goods previously supplied.
8) The company will not accept any variations or alterations to the order placed by the customer unless confirmed in writing by the company, and any such variation or alteration may result in extra charges being made by the company. All goods ordered under contract are purpose – made specifically for the customer’s particular requirements and as such not reasonable to third parties.
9) A credit account is not available and payment is prior to despatch of goods.
10) The company’s products are guaranteed as follows: a) Discolouring and fading for 5 years b) Installation for 1 year
11) Provided the goods are paid for in full delivery, If the company’s products prove to be faulty during that period the company will at the company’s option send a replacement product free of charge.
12) Whilst the company endeavour to ensure that the quality of glass products supplied is first class. It cannot accept liability for defect s or imperfections arising from the glass manufacturing process. Therefore all glass will be to the standards of the glass industry. 13) All reasonable care has been taken but the company shall not be under any responsibility whatsoever for damage to internal or external decorations caused by the legislation.
14) For installation work where scaffolding or a skip is required, a charge will be made to the customer. The company will only pass on to the customer the cost of the scaffolding as charged to the company.
15) Payment of the outstanding balance due to the company falls due for payment prior to delivery of the goods.
16) Customers who have finance company approval for home improvement loans but choose to purchase the company’s goods by alternative means are deemed by the company to be paying cash on installation and therefore clause 15 of these conditions shall not apply.
17) The customers shall be responsible for ensuring that the supply and fitting of the products complies with every applicable statue order in council reputation or direction of government, local or other authority regulations and in particular that he has lawfully obtained every necessary license permit or authority required in connection therewith.
18) The company shall not be liable for any consequential loss sustained by the customer and arising out of the contract now as ever arising.
19) The company does not accept any responsibility for accidental breakage or damage to product by the customer or any third party after leaving despatch, nor any damage after installation.
20) EXTRAS: Additional work carried out or goods supplied not detailed will be charged for in addition to the invoice amount detailed based upon prices current.
21) STYLES: The designs detailed on the order will be as viewed looking from outside at product.
22) SIZES: Sign Frames will be made square which may sometimes leave gaps to be made up or cladded in out of square openings.
